Expertise

Briana has extensive experience in dispute resolution and litigation, and in public and administrative law. She has experience in successfully defending the Commonwealth, Commonwealth agencies, officers and individuals in complex litigation including in tort, contract, consumer law and under the Proceeds of Crime Act. Briana has appeared in various courts, commissions and tribunals around Australia, including in the Federal Court, the Court of Appeal of the Australian Capital Territory, human rights commissions and coronial inquests. Briana also has experience representing individuals the subject of regulatory action.

Experience

Briana’s experience includes acting for:

  • Commonwealth agencies and government owned corporations in respect of the preparation of, and advice on, administrative decisions
  • Organisations, individuals and Commonwealth agencies regarding claims for personal injury, toxic torts, breaches under the Australian Consumer Law, and property damage and recovery, including in Courts of Appeal, Supreme and District Courts, Tribunals and Commissions
  • Commonwealth agencies and individuals in respect of large-scale coronial inquests and investigations
  • Commonwealth agencies, including in the AAT (now the ART), in respect of judicial review applications pursuant to the Safety, Rehabilitation and Compensation Act 1988
  • individuals the subject of regulatory investigations, including the provision of advice during the investigation and on enforcement thereafter
  • insurers and corporations, including the provision of advice on the application of the Insurance Contracts Act, in relation to claims for medical and legal malpractice, personal injury, property damage, and the recovery of statutory payments.
